Hospital Errors

Hospital errors, which would include Outpatient Clinics and Remote Surgical Centers, are far too common across Pennsylvania.

A lack of staff, particularly a lack of experienced doctors, nurses, and technicians, is a leading cause of Hospital Errors that can lead to serious harm to patients, or even death.

Hospital errors can take many forms, ranging from misdiagnosis and medication errors to surgical mistakes and inadequate patient care. When such errors result in harm to a patient, they may give rise to a medical malpractice claim under Pennsylvania law.

Establishing A Hospital Error Case in Pennsylvania

To establish a medical malpractice case in Pennsylvania, several important elements must be proven:

  1. Duty of Care: The healthcare provider, including doctors, nurses, and other hospital staff, owed a duty of care to you or your loved one.
  2. Breach of Duty: The healthcare provider breached the professional standard of care expected in similar circumstances. This means that the provider's actions fell below the accepted medical standards.
  3. Causation: The breach of duty caused or increased the risk of harm or injury to you or your loved one.

Damages:  You or your loved one suffered damages as a result of the hospital error. These damages can include medical expenses, lost wages, pain and suffering, emotional distress, loss of enjoyment of life, and other losses.

In Pennsylvania, medical malpractice claims involving hospital errors are subject to specific rules.  For example, before filing a lawsuit, we must provide a certificate of merit signed by a qualified medical expert attesting to the merit of the claim and confirming that the medical provider deviated from accepted medical standards which caused you harm.

Statute of Limitations

The statute of limitations to file a medical malpractice action is two years, but it can be difficult to determine when the statute of limitations begins to run in these cases, which often requires a complete analysis of all of the facts and circumstances.

If you feel you or a loved one has been a victim of a hospital error, it is important to call our office quickly for a consultation so you do not lose your right to sue based upon time limits.
