Strokes are a serious, life-altering and sometimes deadly medical condition – especially if not immediately diagnosed correctly and properly treated.
Time is a stroke victim’s enemy. Prompt diagnosis and medical intervention is crucial to prevent long-term disability or even death in a stroke victim.
In Pennsylvania, cases of medical malpractice related to strokes have long been a cause of concern, raising questions about the quality of care sometimes provided by healthcare professionals and healthcare facilities.

Understanding Strokes
A stroke occurs when the blood supply to the brain is interrupted, leading to damage of brain tissue. There are different types of strokes, including ischemic strokes caused by a blockage in a blood vessel, and hemorrhagic strokes caused by a rupture of a blood vessel.
Signs of a stroke can include sudden numbness or weakness in the face, arm, or leg, confusion, trouble speaking or understanding speech, trouble seeing in one or both eyes, dizziness, and severe headache. Unfortunately, when someone presents to a doctor or healthcare facility with symptoms of a stroke, sometimes there is a delay in properly diagnosing the stroke, leading to delayed medical intervention to treat the stroke and prevent the worsening of the patient’s condition.
Critical Elements To Be Considered In Any Medical Malpractice Case
- Duty of care – We must show the doctor and medical team owed a duty of care to you or your loved one.
- Breach of duty - We must show your doctor and medical team failed to uphold the expected standard of care by either failing to diagnose the condition within a reasonable amount of time or making an incorrect diagnosis.
- Causation - This is when the delayed or incorrect diagnosis caused or increased the risk of harm to the patient. This can include worsening of the patient's condition, the need for more invasive treatment, a reduced chance of recovery, or even death.
- Damages - We will be required to show you or your loved one suffered damage as a result of the delayed or incorrect diagnosis. These damages can include physical pain, emotional suffering, additional medical expenses, additional medical expenses, loss of income, loss of enjoyment of life, or a worsened prognosis or chance of survival, or in some cases, a preventable death.
Statute of Limitations
The statute of limitations to file a medical malpractice action is two years, but it can be difficult to determine when the statute of limitations begins to run in these cases, which often requires a complete analysis of all of the facts and circumstances.
If you feel you or a loved one has been a victim of a misdiagnosed stroke, it is important to call our office quickly for a consultation so you do not lose your right to sue based upon time limits.
