Obligations of Employers To Injured Workers

Employers in Pennsylvania have a number of legal obligations when it comes to calling for the return to work of employees who have been injured on the job. These obligations include:

1. Employers must secure medical evidence of an injured worker’s ability to return to work.

2. Employers must provide a State form called a Notice Of Ability To Return To Work, alerting the injured party that a medical provider believes the injured worker is capable of returning to work.

3. Employers, in good faith, must verify whether the employer at the time of injury has suitable employment available to the injured worker within the medical restrictions/limitations relied on by the employer.

4. Employers must ensure that the return to work job duties assigned to the injured worker fit within the designated medical restrictions/limitations of the doctor allowing an attempt to return to work.

5. Employers must continue to make modified-duty employment available to an injured worker for as long as the work-related restrictions/limitations continue.  

Your Return To Work Rights

Employees in Pennsylvania also have legal rights when it comes to returning to work after a work-related injury. These rights include but are not limited to:

1. Employees can seek reasonable accommodations for their return to work job duties if the accommodations are based upon work-related disabilities.

2.  Employers are prohibited from retaliating against employees for filing a Workers' Compensation claim or seeking a return to work accommodations following a work injury.
